1. Acceptance of Terms

1.1 By registering with or using the services of BetterWorx Learn Lab (“we”, “us”, “our”), you (“you”, “your”, “learner” or “organisational client”) agree to these Terms & Conditions (“Terms”).

1.2 If you do not agree to these Terms, do not use our services.

2. Services Covered

2.1 These Terms apply to our e-learning modules, assessments, downloadable training materials, webinars, events and related services (collectively “Services”).

2.2 We reserve the right to change or withdraw any Service at our discretion.

3. Eligibility and Registration

3.1 You must provide accurate, up-to-date information when registering.

3.2 If you register on behalf of an organisation, you represent you are authorised to enter into these Terms for that organisation.

3.3 Use of your account is personal (or exclusively for your organisational licence if applicable) and must not be shared unless we specifically authorise a multi-user licence.

4. Payment, Consumption & Refunds

4.1 Payment terms will be as set out at the time of booking/purchase. Unless otherwise stated, all amounts are listed in NZD.

4.2 e-Learning courses: All e-Learning courses purchased are considered consumed at the point of purchase, and no refund will be given except as required by applicable law. (Reflects EMA wording).

4.3 Events, webinars or tailored training: Cancellation by you must be submitted in writing at least 5 working days before the scheduled training (or alternative period we may specify); work completed up to termination will be invoiced.

4.4 We may cancel or defer an event/session; we will offer either a full refund, credit, or reschedule, at our discretion — but we will not reimburse travel, accommodation or other incidental costs incurred by you.

5. Intellectual Property, Use of Materials & Branding

5.1 All content, materials, modules, videos, documents, trademarks and logos on our platform are owned or licensed by us.

5.2 You may use these materials solely for your personal or internal organisational learning and development. Redistribution, resale or modification is strictly prohibited without our written consent.

5.3 If you wish to use our brand/logo (or if we allow your organisation to use the materials with your branding) you must obtain our prior written approval.

6. Certificates & Assessments

6.1 Where provided, certificates or digital credentials may be issued upon successful completion of a course or assessment.

6.2 We reserve the right to revoke or withhold certification in cases of misconduct, plagiarism, or breach of these Terms.

7. International Access & Legal Compliance

7.1 Our Services are accessible globally; however, our marketing and operations are primarily based in New Zealand.

7.2 You are responsible for ensuring your use of our Services complies with local laws and regulations in your jurisdiction.

8. Privacy & Personal Data

8.1 We collect and manage personal information in accordance with our Privacy Policy and applicable New Zealand privacy laws.

8.2 By using our Services, you consent to us contacting you and using your data as set out in the Privacy Policy.

9. Limitation of Liability & Disclaimers

9.1 Our Services are provided “as is” and “as available”. We make no warranties (express or implied) about the accuracy, completeness or suitability of any content for a particular purpose.

9.2 To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special or consequential loss or damage arising out of or in connection with your use of the Services.

9.3 Nothing in these Terms limits any rights you may have under applicable consumer protection laws.

10. Suspension or Termination

10.1 We may suspend or terminate your access immediately if you breach these Terms or misuse the Services.

10.2 You may cancel your account or licence at any time by notifying us; any rights to refund will be subject to clause 4.

11. Changes to Terms

11.1 We may revise these Terms from time to time. Any changes will be posted on our website and will take effect immediately after posting. Continued use of our Services constitutes acceptance of the updated Terms.

12. Governing Law & Jurisdiction

12.1 These Terms are governed by and shall be construed in accordance with the laws of New Zealand.

12.2 You agree to submit to the exclusive jurisdiction of the New Zealand courts for any dispute arising under or in connection with these Terms.
